Why I posted this site?
Some of you may be visiting this site or seeing this information for the first time and wondering, "who is this nut case that is saying an America citizen doesn't have to pay income taxes?" Or you may be thinking, "How can the IRS do what they do to American citizens, if they are not required to file" or maybe something similar. Well first of all I would not tell you that you are not required to pay the income tax. For one because I don't know if you are or aren't. Nor does my site say that if you read it closely. Secondly, I would never tell anyone they don't have to pay income tax. I am not a lawyer and can't give you tax advise. That is a matter you have to determine for yourself after you have studied the law.
However I have cited various sections of the IRC (Internal Revenue Code) and other similar references on this site that indicate that the law regarding income tax is very limited and specific in its application. I have also concluded that by law, I, an America citizen living and working domestically in one of the several states of the union, do not have a requirement to pay a direct tax on my earnings. This is not my opinion but according to the IRC and confirmed by 3 Supreme Court rulings. Therefore I have not filed a 1040 or any other IRS tax form since 1985. Not because I am a tax protester, but simply because I can not find anything, in any law, anywhere that says I am required. In fact I have found just the opposite. I have also written the IRS for years and asked them to cite where in the IRC or the CFR (code of federal regulations) it states I am required to file. I have never received a reply to that question for 18 years now. Not that their silence in itself means I am not required. But if there is a section in the code or anywhere else, why don't they simply cite it and show it to me? They certainly have had ample time to respond. 18 years to be exact. I have even had someone from the Department of Justice and the U.S. Treasury visit my site on several occasions ( around a dozen times at last count ) and I have emailed them referring to their visit and asking them to show me if there is any information on this site that is incorrect. Someone from the U.S. Treasury did acknowledged receipt of my inquiry and said they would pass it on to their supervisor with no further reply. Don't you love bureaucracies?
Some may ask, "but don't you feel you should pay your fair share?" Well yes as a matter of fact I do. But only as the law requires. The laws were set up specifically the way they were for very definite and important reasons. Our form of government did not come out of a vacuum and the Constitution was written as is carefully and deliberately and it clearly lays out the perimeter by which the federal government can and can not raise revenue. It is my humble opinion that if all of us paid our fair share as the law requires us to we would be far better off as a country and as individuals of this still great country. That was the intent of the founders of our government when they wrote the Constitution. As Thomas Jefferson said,
"In questions of power, then, let no more be said of confidence in man, but bind him down from mischief by the chains of the Constitution."
In fact the Constitution in the very first article clearly states in 3 separate sections ( sections 2, 8, and 9 to be exact ) what the requirements are regarding the raising and paying of taxes. Those sections have never been repealed and therefore stand today. Not only for me as a Citizen of the USA but for the government as well. ( some may be surprised to know that the Constitution was written to "police" the government not the Citizens. By the way where did I hear this notion that the government is to be the servant of the people. Hmm! Must have been from one of those government conspiracy right wing radical militia nuts I bet! ) And if our government was functioning according to the law as it is currently written we would not have a 6 Trillion + and growing deficit. ( And that's just what the ADMIT to ) Most would be surprised to know that there is no need for a balanced budget Amendment. The law requiring a balanced budget has been in the Constitution from the beginning and has never been repealed. And incredibly there are some behind the scenes who wish to rewrite our Constitution. Did you hear about that one in the evening news! (by the way did you ever wonder WHO our government owes that money to? Does it owe it to itself? You might be shocked to know. It all started in 1913. If you checked I suspect you would be very upset.) No matter what our understanding of the law is, if you care about your country, your freedom, your future and your kids future, the deficit alone should cause all of us serious concern.
What led me to where I am today was a growing concern over things like the deficit and what I saw in government that didn't appear to coincide with what I understood the Constitution to say. As I probed and researched I was amazed at what I discovered. Surprisingly what I learned is public information on public record for anyone who cares to read it and not some obscure wild conspiracy theory as some are prone to suggest. (It seems lately in the media that anyone who would question any of the actions of the government must be some wild eyed loony who holes up in the mountains with a few guns, missiles and various similar paraphernalia). However I discovered most are like I was and simply didn't know where to look. Or like me they thought they couldn't understand the law even if they did know where to look. Even worse they figured if they didn't hear it in the news it must not be true. They simply believed like I did that the news always covered everything that was of major significance and only covered the facts on everything it did cover. Therefore if it's not in the news it must not be important or factual . Unfortunately I have learned nothing could be further from the truth . ( I do think some in the industry truly desire and attempt to be objective in their reporting. But some do not by their own admission. [See my page, "They told the truth "]. But unfortunately what those who wish to be objective are given or allowed to report on is not within their control when it comes to certain "sensitive" matters. They may be objective about the particular item they are reporting on but if what they are allowed or "encouraged" to report on is not up to them then ultimately we only hear what someone else wants us to. Someone must decide what is and isn't news worthy. Unfortunately it is not necessarily determined by what you and I wish to hear, or by the individual reporter, even though this may be what we have assumed or been led to believe. As I began to learn the facts there was denial at first. I was dumbstruck with what the law appeared to actually say and had a hard time accepting I had been duped so badly. Then I was angry when I realized I had not been told the truth. For example when I learned there was no law requiring me to have a social security # to live and work in the U.S. I was amazed. ( To see a typcial response letter from the SS Administration go to http://taxtruth4u.com/nossn.gif ) . I wrote the Social Security Administration personally and confirmed this. Don't take my word for it! Do it yourself if you aren't convinced. I wondered why everybody appeared to believe just the opposite. I wondered why those I trusted and believed made no attempt to explain this major and important fact. I begin to wonder if someone was deliberately hiding something and what else might possibly be hidden. As I probed it became more and more apparent that things were far worse then I had ever thought possible. But as time went on, I also learned what the law actually said. I was relieved to realize things didn't have to be the way they were according to the law as it is written and therefore could be addressed if enough people just knew the facts. In my opinion, if things are to turn around it will be from the ground up and not from the top down. From the people, the citizenry and not from career politicians. This country was set up with a government by the people and for the people ( not by or for politicians ) If that sounds odd to you it only indicates how far off the original path we have strayed. Our government must still be by and for the people today if it is to be again what it was intended to be and we are to be a free country. You may recall that is why it was originally established to start with. We as citizens must be involved.
As an example of how astray the thinking of some have gone, listen to our past "leader" Bill Clinton regarding the US Constitution:

"And so a lot of people say there's too much personal freedom. ( Hmm. A lot of people? And who might those people be? ) When personal freedom's being abused, you have to move to limit it. ( according to who and by what authority?!) That's what we did in the announcement I made last weekend on the public housing projects, about how we're going to have weapon sweeps and more things like that to try to make people safer in their communities." ( Isn't crime convenient. It is clever what some use to justify their actions. However if something is wrong it is wrong under any circumstances. The Constitution says what it says. We can't dismiss it simply because we wish to. The ends do not justify the means? Emphasis and comments are added and not part of the original article )

Therefore I have posted this site. So there is no confusion I am not opposed to America nor do I advocate violence. (Though our forefathers obviously did believe in defending their God given rights when it was absolutely necessary.) But I am opposed to those who would rob us of our freedom, to deception and those who would rob this country of it's great heritage. I love this country and it is exactly because I do love it and the freedom for which it was founded upon that I seek to pass on what I have learned to those who will listen.
To reassure those who may wonder, I am a normal person ( whatever that may be ). I am the son of a "lifer" in the U.S. Army. I was born on the military base at Fort Benning, Ga. December 14, 1953. Raised in Lawton, Oklahoma. (my dad was stationed at Fort Sill, OK. for several years). I was raised to honor our country and trust our government. I have lived in GA, CA, Germany, OK, NC, VA, SC and currently reside in New England ( yes..... the life of an Army brat ). I was never in the military ( Nixon ended the draft 3 weeks before it was my turn. Thank you Dick! ) nor am I a member of any militia group. ( a common assumption often made and perpetuated by the media of those who might question the actions or honesty of their government. Freedom of speech is still in the Constitution isn't it? OK. Just checking. ) I am not even a member of the NRA. ( no letters from NRA members please. I have nothing against you ) I am a College graduate from Columbia Bible College in Columbia SC. ( just missed honors because New Testament Greek was a killer. Some graduate "suma cum laude." I graduated "thank the Lordy" ) I majored in Bible and minored in Psych and Philosophy. I am the father of 4 kids; 3 sons and a daughter. All in the work world now but "my baby", 21 this year (2005) who is in College. My wife and I are lay ministers in our church and lead a small home group fellowship. ( by the way that makes me particularly dangerous you know. Church goers are a real threat to our country ). I have been a residential counselor ( not a resident. There is usually a difference ) in a mental health program since 94 and also an Independent Representative for SAPF since 95. I had moved through the ranks of the then A.L. Williams and Associates marketing group from 1982 through 1993 to the Senior Vice President ( a fancy title for a senior field sales manager). I have since stepped down because my family was getting older and it was all evening work.
